In this privacy policy, JobCloud HR Tech GmbH (hereinafter referred to as “we” or “JobCloud HR Tech”) explains how we process and protect personal data. Personal data refers to all information relating to an identified or identifiable person.

Description

You can test our product “CVlizer®” free of charge for your own purposes (https://jobcloud-hrtech.com/cvlizer/). The personal data you provide will only be stored for the duration of the processing. An anonymized data record of your data will be stored for statistical purposes. If critical errors occur during processing, the transmitted data will be reviewed for the purpose of improving the service. With the CVlizer demo, we offer users and interested parties the opportunity to test the functionality and accuracy of the software in advance without obligation.

Sending the Extraction Results

Description 

After using the CVlizer demo, the extracted data can be transmitted in a machine-readable format. This service is primarily aimed at interested parties who wish to use CVlizer commercially. The contact details of the interested party are required for transmission. The purpose of processing the contact details of the interested party is to enable contact to be made for the purpose of initiating business.

Microsoft Bookings

To schedule our product demos we use the Microsoft Bookings online booking system. When using this tool, contact details such as your name and email address are collected for the purpose of displaying and selecting appointments. The data you enter will remain with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies.

The legal basis for data processing is Art. 6 (1) lit. f GDPR. The website operator has a legitimate interest in making it as easy as possible to schedule appointments with interested parties and customers. If consent has been requested, Art. 6 (1) lit. a GDPR is the legal basis for data processing; consent can be revoked at any time.

Communication via WhatsApp

We use the instant messaging service WhatsApp, among other things, to communicate with our customers and other third parties. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from accessing the communication content. However, WhatsApp does have access to meta data generated during the communication process (e.g., sender, recipient, and time). The communication content exchanged between and on WhatsApp remains with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed).

JobCloud HR Tech uses artificial intelligence (AI) technologies in selected areas. This refers to systems and applications that operate on the basis of training rather than human programming. This enables them to recognize patterns or generate or modify content. No AI systems prohibited under the European AI Act are used. The output of AI systems is not used to make automated decisions in individual cases, including profiling within the meaning of Art. 41 DSG and Art. 22 EU GDPR. We have regulated the use of AI within the framework of internal AI governance, weigh up opportunities and risks in advance, and ensure appropriate human supervision. If we offer dialogues with AI, we make this clear and, if necessary, also point out possible errors.

As it is important to us to keep pace with technological advances in order to offer you even more efficient and better services, we use selected personal data that you provide to us or that we collect from you as described in this privacy policy to (i) develop our own AI techniques, (ii) train, (iii) test, (iv) validate, and (v) use them. Our AI techniques are used to provide, facilitate, and/or improve our services. This means, for example, that we use AI to optimize your search results or to better understand which requirements are crucial for a job. Please note that our AI techniques may be based on third-party AI systems. However, we ensure that such third-party AI providers do not have access to your personal data. SOCIAL MEDIA PROFILES/PAGES

JobCloud HR Tech operates social media profiles/pages to inform you about offers, events, services, promotions, competitions, and company news, and to interact with visitors to the social media profiles and our customers. For details on data processing, please refer to our privacy policy on the respective social media platforms (Facebook, X, YouTube, Instagram, LinkedIn).

COOKIE AND TRACKING TECHNOLOGIES

JobCloud HR Tech uses cookies and other similar tracking technologies, including third-party technologies, on the JobCloud HR Tech website, in email communications, and in other online services provided by the company. They are used to enable, improve, personalize, and analyze the use of our services, as well as for personalized advertising purposes. Our cookie notice explains what these technologies are, why and how we use them, and your rights to control our use of these technologies.

Conducting Sweepstakes & Competitions

We regularly hold competitions and sweepstakes. For this purpose, we only use personal data that we have collected specifically for the competition and with the express consent of the participants (e.g., first and last name, contact details, address details). The respective terms of use and the respective privacy policy apply to the conduct of the competitions and the processing and storage of personal data in the context of competitions and sweepstakes.

EVENTS

We use your personal data in connection with various events for which you register thro and participate voluntarily. For this purpose, we only process the personal data you provide (amongst others email address, name, company, position).
 

The processing is carried out within the framework of performing (pre-)contractual obligations towards event participants pursuant to Art. 6 (1) lit. b GDPR for (i) registration and (ii) handling the event and (iii) contacting you if necessary during the event. Additionally, it is based on our legitimate interests under Art. 6 (1) lit. f GDPR, which consist of the preparation and execution of events. 

We process your personal data in order to prepare for the event and to be able to grant access on the day of the event.

Video and photo recordings

Video and photo recordings may be taken during the event, which may also include participants. We use these recordings based on our legitimate interests under Art. 6 (1) lit. f GDPR for (i) documentation and (ii) internal and external reporting on the event, including posts on our website, social media channels, or on the internet. If we cannot rely on legitimate interests as the legal basis for the use of images, we will obtain your separate consent in accordance with Art. 6 (1) (a) GDPR. Your data related to event registration will be stored only as long as necessary to organize the event and, beyond that, only for as long as required by statutory retention obligations.

PREVENTION OF CRIMINAL OFFENSES, MEDIATION, AND COMPLIANCE WITH LEGAL REQUIREMENTS

Your personal data may also be used to detect or prevent fraud or other illegal activities. Reports regarding illegal content can be made to JobCloud HR Tech by email. Details on the reporting and remedy procedure for illegal content can be found in the following section. If you exercise your rights as a data subject, we will process your personal data for the purpose of handling these requests in accordance with the statutory processing and retention periods.

REPORTING AND REMEDY PROCEDURES WITH REGARD TO ILLEGAL CONTENT

Reporting Illegal Content

Reports regarding illegal content can be made to JobCloud HR Tech at the following email address: datasecurity@jobcloud-hrtech.com. Please provide as much detail as possible regarding the identification of the illegal content and the reasons for its illegality.

JobCloud HR Tech will check whether the report contains sufficient information to assess the illegality of the reported content. If the report does not contain all the information necessary for an assessment, JobCloud HR Tech will inform the person who made the report. JobCloud HR Tech reserves the right to reject incomplete reports.

Ruling and Legal Remedies

Upon receipt of a report, JobCloud HR Tech will review the reported content for compliance with applicable law and the terms and conditions for business customers. If JobCloud HR Tech assumes that the content is illegal, JobCloud HR Tech may restrict or remove the illegal content.

If the contact details of the person concerned are available, JobCloud HR Tech will provide them with a reasoned decision on the content moderation measures taken and inform them of the relevant legal remedies. JobCloud HR Tech will also inform the reporting person of the decision, including the reasons and reference to the relevant legal remedies.

THIRD-PARTY OFFERS

JobCloud HR Tech also presents third-party offers on the JobCloud HR Tech website and in its emails and newsletters, and provides links to third-party offers or websites. JobCloud HR Tech accepts no responsibility for the collection and processing of personal data by third parties and their services and applications. Within the scope of our business activities and the purposes set out in this privacy policy, we also disclose personal data to third parties, insofar as this is permitted and appears appropriate to us, either because they process it for us or because they wish to use it for their own purposes.

Service Providers

To provide our services, we use the following categories of service providers, among others: hosting providers, cloud service providers, providers of parsing and matching solutions, advertising service providers, tracking technology providers, social media platforms, and companies specializing in credit checks. Certain members of our group of companies act as service providers for us. Our service providers are predominantly processors and are therefore bound by data processing agreements to treat your data confidentially and exclusively on behalf of JobCloud HR Tech in compliance with appropriate security measures. However, in exceptional cases where they may be controllers, we ensure that any transfer is strictly within the limits of what is legally permitted.

Authorities

We will only transfer your personal data to authorities if we are required to do so within the scope of our legal obligations.

Purchasers or Parties Interested in Purchasing Business Divisions, Companies, or Other Parts of The JobCloud Group

We only disclose personal data to purchasers or parties interested in purchasing business areas, companies, or other parts of the JobCloud Group to the extent necessary for the review or execution of corporate transactions such as company acquisitions, sales, and mergers.

Transfer Abroad

Your personal data is generally processed in EU countries. However, our recipients may be based anywhere in the world, including outside the European Union, e.g. in the USA. We only transfer your personal data to recipients in countries that the EU Commission and the Swiss Federal Council have determined to have an adequate level of data protection. If, in exceptional cases, we transfer your personal data to a country without adequate legal data protection, we contractually oblige the recipient to comply with the applicable data protection regulations (for this purpose, we use the revised standard contractual clauses of the European Commission, which are available here: https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj), unless the recipient is already subject to a legally recognized set of rules for ensuring data protection and we cannot rely on an exception. An exception may apply in particular in the case of legal proceedings abroad.

DATA SECURITY

Google ReCAPTCHA

We use technical and organizational security measures to protect the data we manage against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons in accordance with the current state of the art. The security measures are continuously improved in line with technological developments.

We use Google ReCAPTCHA to protect our websites as best as possible against bots and spam software and to protect them from misuse by non-human visitors. To protect and optimize our services and combat cyber attacks, certain technical data is collected using cookies. For more information, please refer to the cookie notice in this privacy policy.

Wordfence

We have integrated Wordfence into this website. Wordfence serves to protect our website from unwanted access or malicious cyber attacks. For this purpose, our website establishes a permanent connection to Wordfence’s servers so that Wordfence can compare its databases with the accesses made on our website and block them if necessary.

HOW LONG DO WE STORE YOUR DATA?

Personal data will be permanently and irrevocably deleted or anonymized if (i) you instruct us to do so or when the contract ends, i.e. when you or we terminate the contract, (ii) we do not need the data for the performance of the contract, we are not legally obliged to retain it, or we do not need the data for the assertion, exercise, or defense of legal claims or other overriding interests.

Please note that for technical and/or organizational reasons, it may take a few days for your data to be permanently and irrevocably deleted.

We use personal data that is not directly related to the provision of services by JobCloud HR Tech for as long as this is necessary and we are entitled to do so. After this period has expired, we will permanently and irrevocably delete all your personal data or anonymize it.

WHAT ARE YOUR RIGHTS?

Within the scope of the data protection law applicable to you and to the extent provided for therein, you have the right to information, correction, deletion, restriction of data processing, and objection to our data processing, as well as to the disclosure of certain personal data for the purpose of transfer to another location (so-called data portability). If you have given us your consent to process your personal data for specific purposes (for example, when you register to receive newsletters), we will process your personal data within the scope of and based on this consent, unless we have another legal basis and require one. Consent that has been given can be revoked at any time, but this has no effect on data processing that has already taken place. Log files: When you visit our platforms, general access data is stored in a log file for statistical purposes. This log information includes the following elements: IP address, date and time of access, name of the file accessed, access status (OK, partial content, document not found, etc.), page from which access was made, top-level domain (*.ch, *.fr, *.com, etc.), web browser used, operating system used, platform used (desktop or mobile device). JobCloud HR Tech processes such data in anonymized form, for example to determine on which days there are particularly high numbers of visits. There is no personalized evaluation of the log files.

Google Consent Mode Advanced: JobCloud HR Tech uses Google Consent Mode to assess the performance of our marketing campaigns and user behavior. Google Consent Mode sends pings without cookies to Google servers, regardless of cookie consent settings. Pings without cookies may contain the following information as part of regular HTTP/browser communication:

IP address, screen size and resolution, browser information, your location (country), preferred language setting, visited web pages/subpages, interactions with website elements (clicks, scrolling, mouse movements), date and time of access to the web pages, etc.
